Please read these Terms and Conditions ("Terms") carefully before using the PluginOS mobile application and related services (the "Service") operated by Plug-in Promotions, Inc. ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the PluginOS application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

PluginOS is a device management platform that allows users to manage Plugin smart display devices. The Service enables users to associate devices with their account, upload content, manage playlists, and display promotions on connected Plugin devices deployed at venue locations.

3. User Accounts

To use the Service, you must create an account using Google Sign-In. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. User Content

You may upload photos, images, and other content ("User Content") to the Service for display on Plugin devices. By uploading User Content, you represent and warrant that:

  • You own or have the necessary rights and licenses to use and display the content
  • The content does not infringe on the intellectual property rights of any third party
  • The content does not contain unlawful, defamatory, obscene, or otherwise objectionable material
  • The content complies with all applicable laws and regulations

We reserve the right to remove any User Content that violates these Terms without prior notice.

5. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by Plug-in Promotions, Inc. and is protected by copyright, trademark, and other intellectual property laws. The Plugin and PluginOS names, logos, and branding are trademarks of Plug-in Promotions, Inc. You may not use our trademarks without prior written consent.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Interfere with or disrupt the Service or connected Plugin devices
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any purpose that is fraudulent or otherwise harmful

7. Device Management

Plugin devices are associated with user accounts via MAC address. You are responsible for the devices linked to your account. Tampering with, modifying, or misusing Plugin hardware may result in account termination and may void any warranties associated with the devices.

8. Third-Party Services

The Service integrates with third-party services including Google Sign-In, Firebase, and other platforms. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Plug-in Promotions, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Plug-in Promotions, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the PluginOS app or by contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in West Virginia.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
